The Qualification Management Regulations of Hydraulic Engineering Construction Supervision
Chapter One General Principles
Article One
In order to strenghen the qualification management of hydraulic engineering construction supervision, to standardize the market order of hydraulic engineering construction, to ensure the quality of hydraulic engineering construction, we set this regulations according to Construction Project Supervision Regulations, The Saving Decision of Administrative Licensing of Items Requiring Adminstrative Approval and other regulations.
Article Two
Affirmation and management of hydraulic engineering construction company quality(refered to the Supervision Company), which suits this regulations
Artcle Three
The supervision business company should acquire the qulification according to this regulations, and we should hire the hydraulic engineering construction supervision business in the range of qualification level.
Article Four
Applying the qualification of supervision (the applicants), should apply the relevant qualification level according to their owned technical director, professional technicists, registered capital and engineering supervision achievements and some other conditions.
Article Five
Ministry of Water Resources is responsible for the affirmation and management of supervision companies qualification.
Ministry of Water Resources belongs to the River Basin Management Agency (refered as Watershed Management Organization) along with People’s governments of provinces, autonomous regions and municipalities directly charges of receiving, transiting and management of relevant supervision companies qualifications application materials.
Chapter Two Rank of Qualifications and Scale of Business
Article Six
The qualification of supervision companies is devided into the supervision of gydraulic project construction, the supervision of erosion and torrent control works, the supervision of electromechanical and metal structure equipment manufacture and the supervision of hydraulic engineering environmental protection. Among which, we have Class-A, Class-B, and Class-C in the supervision of gydraulic project construction and the supervision of erosion and torrent control works, and Class-A and Class-B in the supervision of electromechanical and metal structure equipment manufacture, then there is no class in the supervision of hydraulic engineering environmental protection.
Article Seven
The available business in various qualification ranks followed:
I. The professional qualification supervision of hydraulic project construction,
Class-A can take up the various construction observation business of hydraulic project.
Class-B can take up the second level or below construction observation business of hydraulic project
Class-C can take up the third level or below construction observation business of hydraulic project.
The standard of classification is carried out the Classification of Hydraulic and Hydro-Power Engineering and Flood Standard（SL252-2000）.
II. The professional qualification supervision of erosion and torrent control
Class-A can take up various construction observation business of erosion and torrent control
Class-B can take up the second or below construction observation business of erosion and torrent control.
Class-C can take up the third or below construction observation business of erosion and torent control.
In the meanwhile, the company should have the professional qualification of hydraulic engineering construction and over the Class-B professional qualification of erosion and torrent control, in this way, the company can take up the supervision business of constructing the backbone of silt arrester.
The criterion of classfication of erosion and torrent control which suits this regulations is in the Enclosure Two.
III. The professional qualification of electromechanical and metal structure equipment manufacture
Class-A can take up the supervision business of various electromechanical and metal structure equipment manufacture.
Class-B can take up the supervision business of meddium and minitype electromechanical and metal structure equipment manufacture.
The criterion of classfication of various electromechanical and metal structured equipment which suits this regulations is in the Enclosure Three.
IV. The professional qualification of hydraulic engineering construction environmental protection
It allows you to take up various ranks of supervision business of hydraulic engineering construction environment protection.
Chapter Three The Application, Acceptance and Affirmation of Qualification
Article Eight
Applying for the qualification of supervision company, which should have the condition of the Criterion of Classfication of Hydraulic Engineering Supervision Company Qualification.
The qualification of supervision company applys step-by-step according to the majors.
The applicants can apply for more than one professional qualifications.
Article Nine
The qualification of supervision affirms once annually, the acceptance time will announce to the society ahead of three months by Ministry of Water Resources
After the apart of supervision company should affirm the qualification again or change the qualification or prolong it, which is not suitable for the above regulations.
Article Ten
The applicants should hand in the applying materials to the Ministry of Water Resources of provinces, municipality or municipality people’s government. However, the subordinate company sole proprietorship or holdings enterprises want to apply the supervision qualification, you should hand in the materials to Ministry of Water Resources.
The Ministry of Water Resources of provinces, municipality or municipality people’s government should give advice in 20 workdays since receiving the applying materials, and transit the materials to Ministry of Water Resources.
Article Eleven
First applying for the supervision qualification, the applicants should hand in the following materials:
I. The Rank Application Form of Hydraulic Engineering Construction Supervision Qualification
II. The License of the Business Corporation or The Registration of Company Name in Advance is approved by Industrial and Commercial Administrative Department.
III. Capital Verification Report
IV. Articles of Incorporation
V. The identification paper of legal repersentative
VI.The documentary evidence of The Rank Application Form of Hydraulic Engineering Construction Supervision Qualification should be agreed by supervisors qualifications and applications, the post certificate of chief supervisory engineer, cost personnel qualication or title certificate, and the employment contracts of the above supervisors and cost staffs.
Applying for promotion, affirming again or prolonging the supervision qualification, you should hand in the following materials except the above stated materials:
I. Former Qualification Ranked Certificate of Hydraulic Engineering Construction (Copy)
II.All the supervising engineers registered certificates which listed in The Rank Application Form of Hydraulic Engineering Construction Supervision Qualification
III.Undertaking the hydraulic engineering construction supervision contracts approximately three years, and the evaluation opinions of finished construction company.
The applicante should hand in all the relavant material and reflecting the real conditions, and be responsible for the authenticity of applying materials.
Article Twelve
Ministry of Water Resources should give the response for whether affirming that or not with in 20 workdays since acceptance; if cannot work out within 20 workdays, it can prolong another 10 workdays by the permission of relavant principals. If it can be affirmed, the principals should inform the applicants in written notice and clarifying the reasons.
Article Thirteen
Befor making decision, Ministry of Water Resources should judge the applying materials, and it should be published at the website of Ministry of Water Resources, the published time at least is 7 days.
Ministry of Water Resources should make the Time Notification of Water Administrative Licensing, and inform the applicants the public time and judgement.
Article Fourteen
The Qualification Ranked Certificate of Hydraulic Engineering Construction includes one original and four copies, both original and copy has the same legal effect, the validity is 5 years.
Article Fifteen
In the valid time of qualification, the name, address, legal repersentative and other business registration will be changed, you should hand in the evidentiary material to Ministry of Water Resources in 30 workdays since changed. Ministry of Water Resources will handle the alteration procedure within 3 workdays since receiving the alteration applying materials.
Article Sixteen
About the discrete supervision company, you should hand in the relavant applying materials and dicrete resolution and supervision achievements segmentation agreement in 30 workdays after split-off according to the Ariticle Ten and Article Eleven, in order to apply the affirmation of the qualification of supervision company
Article Seventeen
If the effect exhaustion of qualification certificate needs standing, supervision companies shou hand in the application of prolonging the qualification rank to Ministry of Water Resources ahead of 30 workdays in valid time according to the Article Ten and Article Eleven. Ministry of Water Resources should decide whether permit before the valid time.
Article Eighteen
Ministry of Water Resources should inform the condition of giving out, alteration or prolonging of qualification rank certificates to the relavant Water Administration Management of provience, municipality or municipality people’s government, and make the announcement on the website of Ministry of Water Resources at regular intervals.
Chapter Four Supervision
Article Nineteen
Ministry of Water Resources set up the supervision displines of supervision company so that it can carry out the dynamic management to the supervision company.
Article Twenty
When the Ministry of Water Resources performance the responsibilities, the relavant companies and staffs should provide relavant materials objectively and truthfully.
Article Twenty-one
If obbeying the regulations should be punished according to the Administration Permission Law of the People’s Republic of China,
Chapter Five Supplementary Articles
Article Twenty-two
Ministry of Water Resources set the same form of the application form of hydraulic engineering construction supervision qualification, acceptance proof, the additions and corrections notification of applying materials and off the docket notification, the Qualification Ranked Certificate of Hydraulic Engineering Construction is printed by Ministry of Water Resources.
Article Twenty-Three
The regulations has acquired the qualification ranked certificate of hydraulic engineering construction, it remains in force after carrying out it. After it carrys out, the promotion, changing, prolongign and affirmation of qualification according to this regulation.
Article Twenty-four
This regulation is carried out on February 1st, 2007. the Regulations of Hydraulic Engineering Construction Supervision Company will be abolished at the same time.
